ImportSend.io Terms of Service

These Terms of Service (“Terms”) govern your use of ImportSend.io (“the Service”) provided by [Your Company Name] (“we,” “us,” or “our”). 1. Acceptance of Terms

If you are accessing or using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

ImportSend.io is a bulk email software that allows users to send emails to multiple recipients. The Service provides various features and functionalities related to email sending, list management, analytics, and related services. We may modify, update, or discontinue any part of the Service at any time without prior notice.

3. User Obligations

By using the Service, you agree to:

3.1. Provide accurate and complete information during the registration process and maintain the accuracy of your account information. 3.2. Use the Service in compliance with all applicable laws, regulations, and third-party terms and policies. 3.3. Keep your account credentials confidential and not share them with unauthorized individuals or entities. 3.4. Assume responsibility for all activities conducted under your account and promptly notify us of any unauthorized access or use.

4. Prohibited Activities

You are expressly prohibited from engaging in the following activities when using the Service:

4.1. Sending unsolicited or unauthorized emails (spam) to individuals or entities. 4.2. Violating any laws, regulations, or third-party rights, including intellectual property rights. 4.3. Uploading or transmitting any viruses, malware, or harmful code. 4.4. Interfering with or disrupting the integrity, security, or performance of the Service or its underlying infrastructure. 4.5. Collecting or harvesting any personally identifiable information of other users or recipients without their consent. 4.6. Engaging in any activity that is illegal, harmful, or objectionable, as determined by us.

5. Intellectual Property

All intellectual property rights in the Service, including but not limited to trademarks, copyrights, and trade secrets, are owned by us or our licensors. You acknowledge and agree that you will not reproduce, modify, distribute, or create derivative works based on the Service, except as expressly authorized by us.

6. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the Service, even if we have been advised of the possibility of such damages.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms constitute the entire agreement between you and ImportSend.io regarding your use of the Service and supersede any prior or contemporaneous agreements, understandings, or representations, whether oral or written.

13. Refund Policy

Due to the nature of the service, all sales are final and customers are allowed to cancel their subscription at any time.

14. Chargebacks & Payment Disputes

14.1. No Chargebacks After Service Activation
By purchasing or subscribing to the Service, you acknowledge that ImportSend.io provides immediate digital access, infrastructure provisioning, and resource allocation (including but not limited to IP assignment, server configuration, and email processing capabilities). Once login credentials are issued or the Service is accessed, the Service is deemed delivered and activated.

Initiating a chargeback, payment dispute, or reversal after accessing or using the Service constitutes a material breach of these Terms.

14.2. Unauthorized Chargebacks
If a user initiates a chargeback or payment dispute after service activation or usage, ImportSend.io reserves the right to:

  • Immediately suspend or permanently terminate the account;

  • Revoke access to all associated infrastructure and services;

  • Report the incident to the payment processor as fraudulent use of digital services;

  • Recover the disputed amount through legal means.

14.3. Recovery of Costs
In the event of a chargeback filed after service usage, the user agrees to remain liable for:

  • The original subscription amount;

  • Any chargeback or dispute fees imposed by the payment processor;

  • Administrative costs;

  • Reasonable legal fees and recovery expenses;

  • Any demonstrable damages caused to infrastructure, IP reputation, or business operations.

14.4. Manual Repayment Obligation
If a chargeback is resolved in the user’s favor despite evidence of service usage, the user agrees to manually remit the full outstanding amount within seven (7) days of written notice from ImportSend.io. Failure to do so may result in civil and/or criminal proceedings for recovery and fraud under applicable Indian laws.

14.5. Fraudulent Activity
Filing a chargeback after knowingly accessing and using the Service may be treated as intentional misuse of digital services. ImportSend.io reserves the right to pursue all remedies available under applicable law, including claims under provisions relating to cheating, breach of trust, and recovery of money.

14.6. Evidence & Logs
Users acknowledge that ImportSend.io maintains detailed logs including but not limited to login timestamps, IP access records, sending activity, infrastructure usage, and configuration changes. Such records shall serve as binding evidence in any dispute regarding service delivery or usage.
